The terms that govern use of the DataRemote.com website, including permitted use, intellectual property, disclaimers, and limitation of liability.
1. Agreement to these terms
These Terms of Service (the “Terms”) govern your access to and use of the DataRemote.com website and its content (the “Site”), operated by DataRemote, Inc. (“DataRemote,” “we,” “us”). By accessing or using the Site you agree to these Terms. If you do not agree, do not use the Site.
These Terms govern the website only. Your purchase or use of DataRemote products and services is governed by separate agreements — including any master service agreement, order form, end-user license agreement, and our Limited Warranty — and those agreements control over these Terms for the products and services they cover.
2. Changes
We may revise these Terms from time to time. The “last updated” date at the top of this page shows when they last changed, and the revised Terms take effect when posted. Your continued use of the Site after a revision is posted constitutes acceptance of the revised Terms.
3. Use of the Site
You may use the Site for lawful purposes connected with evaluating, purchasing, deploying, or supporting DataRemote products and services, and for reading the educational material we publish. You agree not to:
- interfere with or disrupt the operation or security of the Site, or attempt to gain unauthorized access to any system, account, or data;
- probe, scan, or test the vulnerability of the Site other than through coordinated disclosure to us;
- use automated means to scrape, harvest, or bulk-download Site content, except for public search-engine indexing and reading of the machine-readable resources we deliberately publish for that purpose;
- misrepresent your affiliation with any person or organization, including in forms submitted through the Site;
- use the Site to transmit malware, spam, or unlawful material; or
- remove or obscure any copyright, trademark, or other proprietary notice.
4. Content is informational — not professional advice
The Site’s guides, articles, definitions, and other educational content are provided for general information. They are not engineering, legal, or code-compliance advice. Fire alarm, life-safety, elevator, and similar systems are governed by codes and standards as adopted and interpreted in your jurisdiction, and requirements vary by model, endpoint, installation, configuration, carrier, monitoring provider, code edition, and the authority having jurisdiction (AHJ). Always confirm requirements with your AHJ and qualified professionals before making decisions that affect life-safety systems. Product specifications and certification information on the Site are provided as described on the relevant product pages and may change; the documentation delivered with a product controls over the Site.
5. Intellectual property
The Site and its content — text, graphics, images, page designs, and underlying code — are owned by DataRemote or its licensors and are protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-exclusive license to access the Site and to view, download, and print its content for your internal business evaluation and use. No other rights are granted. DataRemote trademarks, including POTS IN A BOX®, may be used only as described in our Trademark guidelines. Patent information is available on our Patents page.
6. Feedback
If you send us feedback, suggestions, or ideas about the Site or our products, you grant DataRemote a perpetual, irrevocable, royalty-free license to use them without restriction or obligation to you. Do not send information you consider confidential through the Site’s public channels.
7. Third-party content and links
The Site links to, and embeds content from, third parties — for example carrier resources, standards bodies, video platforms, and press coverage. That content belongs to its providers and is governed by their terms; we do not control it and are not responsible for it. A link is not an endorsement.
8. Privacy
Our collection and use of information through the Site is described in our Privacy Policy and Cookie Policy.
9. Disclaimer of warranties
THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED AVAILABILITY. THIS SECTION APPLIES TO THE WEBSITE ONLY; WARRANTIES FOR DATAREMOTE PRODUCTS ARE STATED EXCLUSIVELY IN THE LIMITED WARRANTY AND APPLICABLE PRODUCT AGREEMENTS.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DATAREMOTE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, AND DATAREMOTE’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW.
11. Indemnification
You will indemnify and hold DataRemote harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your misuse of the Site.
12. Governing law and venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising out of these Terms or the Site will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to their jurisdiction.
13. General
If any provision of these Terms is held unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and DataRemote regarding the Site and supersede prior understandings about the Site. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
